Historical Fiction: China’s South China Sea Claims

thediplomat – The Spratly Islands—not so long ago known primarily as a rich fishing ground—have turned into an international flashpoint as Chinese leaders insist with increasing truculence that the islands, rocks, and reefs have been, in the words of Premier Wen Jiabao, “China’s historical territory since ancient times.” Normally, the overlapping territorial claims to sovereignty and maritime boundaries ought to be resolved through a combination of customary international law, adjudication before the International Court of Justice or the International Tribunal for the Law of the Sea, or arbitration under Annex VII of the United Nations Convention on the Law of the Sea (UNCLOS). While China has ratified UNCLOS, the treaty by and large rejects “historically based” claims, which are precisely the type Beijing periodically asserts. China ‘Internationalizes’ South China Sea Dispute

China effectively internationalized its dispute with Vietnam over an oil rig in the South China Sea on Monday by submitting its claim against Hanoi to the UN Secretary General.

As Shannon reported yesterday, on Sunday China’s Foreign Ministry released a statement entitled, The Operation of the HYSY 981 Drilling Rig: Vietnam’s Provocation and China’s Position, which criticized Vietnam’s alleged provocations over the oil rig and provided the “most comprehensive outline to date of China’s claims to the Paracel Islands.” Continue reading China ‘Internationalizes’ South China Sea Dispute

Vietnamese woman burns self to protest China: official

A Vietnamese woman carried banners protesting China to the front gate of Reunification Palace in Ho Chi Minh City and burned herself to death early Friday morning, a city official has confirmed to Thanh Nien.

Le Truong Hai Hieu, vice chairman of District 1 government, says they believe the suicide was inspired by a combination of serious life problems and anger created by China’s placement of a mobile oil rig in Vietnamese waters.

New developments with the Chinese oil rig in Vietnam’s water – May 10 Update

1. ASEAN Foreign Ministers on May 10th issued a statement pressed their serious concerns over the on-going developments in the East Sea, which have increased tensions in the area.

The Foreign Ministers urged all parties concerned, in accordance with the universally recognized principles of international law, including the 1982 UN Convention on the Law of the Sea (UNCLOS), to exercise self-restraint and avoid actions which could undermine peace and stability in the area; and to resolve disputes by peaceful means without resorting to threat or use of force. They reaffirmed the importance of maintaining peace and stability, maritime security, freedom of navigation in and over-flight above the East Sea, as well as the ASEAN’s Six-Point Principles on the East Sea and the Joint Statement of the 15th ASEAN-China Summit on the 10th Anniversary of the Declaration on the Conduct of Parties in the East Sea. They also called on all parties to the Declaration on the Conduct of Parties in the East Sea (DOC) to undertake full and effective implementation of the DOC in order to create an environment of mutual trust and confidence. They emphasised the need for expeditiously working towards an early conclusion of the Code of Conduct in the East Sea (COC).

2. On May 9th, 3 people from fishery surveillance forces of Vietnam were injured. That made the total number of Vietnamese people injured to 9.

On May 10th, China aggressively expanded its protection zone around the oil rig HD-981 from 3 up to 10 nautical miles. China’s military airplanes are detected around the oil rig, some of which are reported to be at the heights ranging from 200 to 300 meters above Vietnam vessels.

On the same day, one fishery boat of Vietnam was rammed and attacked while fishing at 16.45 North latitude, 111.20 east longitude around the Paracel Islands.

Tensions between China and Vietnam over the disputed South China Sea are at their highest levels in years. On May 2, the state-owned China National Offshore Oil Corporation (CNOOC) placed its deep sea drilling rig HD-981 in disputed waters south of the Paracel Islands. Vietnam objected to the placement, declaring that the is located on its continental shelf. China has since sent approximately 80 ships, including seven military vessels, along with aircraft to support the rig. Service learning

As manager of a homeless center at St. Stephen’s Episcopal Church in Pennsylvania, Stephanie wrote down on my Service Learning report as follows: “Tam was a wonderful help in our toy area and food pantry. She washed and dried the toys so the children that come to REACH with their families could play with them while I helped the parents find the resources they needed. Also, Tam assisted us in the food pantry by organizing the client cards, dusting and stocking shelves. Through all, Tam maintained a smile and a positive attitude.” I feel happy and re-reading the comment; however, inspired by one of Chị Hằng’s recent posts, I think it would be much happier if I share s the experience with our friends in Dot Chuoi Non.
